Overview
If you are engaged to be married and your fiancé is from another country, your fiancé should get fiancé K1 visa so that he/she can live with you in the US. The K1 Visa program allows US citizens to marry persons of different nations and bring them into the United States. In order to get this visa for your fiancé, you should first know all the required documents that you will be expected to submit.
In order to apply for fiancé K1 visa, you must submit proof of US citizenship of the petitioner, copy of birth certificate or passport, proof that both are willing and free to marry, proof that the marriage will take place within 90 days of visa approval, and proof to show that they had met in the last two years. The last condition does not apply to people who practice culture that prevent couples from meeting before marriage. You will also be asked to submit a form for reference checks that verifies the biographical information of both the petitioners. You will be asked to give your photographs in the application. In case you or your fiancé had been previously married, you will be asked to submit proof of termination of marriage. If your fiancé has children from a previous marriage and they are below 21 years old, you have to mention it in the fiancé visa application.
The application should be submitted to the Department of Homeland Security's US Citizenship and Immigrations Services (USCIS) office in the area where you live. The cost for filing an application is generally around $455.
Before submitting the application, it is advisable to make copies of all the documents that are being submitted. They not only eliminate any potential problems but also help you replace document if any are missing perchance. After the application and required documents are submitted, a personal interview will be conducted. If there are any conditions that could lead to denial of the fiancé visa, you should make the necessary preparations.
Once your fiancé visa is approved, it would be advisable to prepare the required paperwork for permanent residency. This has to be done within 90 days of marriage or else the fiancé may be asked to return to country of birth.
